The website cartelcycles.cafe (the “Site”) is operated by SARL MVMT, a French limited liability company with a share capital of €176,000, whose registered office is at 49 rue Victor Hugo, 63110 Beaumont, France, registered with the Clermont-Ferrand Trade and Companies Register under number 529 614 398 (EU VAT number FR84529614398), which also operates the Cartel Cycles & Café shop at 12 place d'Espagne in Clermont-Ferrand and the Victoire and Distance brands (“Cartel”). Article 1 – Scope
These general terms of sale (the “Terms”) apply to all distance sales concluded on the Site between Cartel and any person making a purchase (the “Customer”). Placing an order implies acceptance of the Terms in force on the day of the order, which the Customer acknowledges having read before confirming the purchase.
Article 2 – Products
The Site offers components, accessories, coffee items and bikes. Bikes may be new, ex-display, ex-demo or used: their condition, their mileage where applicable and any signs of use are described on each product page. Photos are as accurate as possible but are not contractually binding; the Customer is invited to read each product description and to contact us with any question before buying, in particular about the size and geometry of a bike.
Article 3 – Prices
Prices are shown in euros, including all taxes, excluding shipping costs. Shipping costs are shown before the order is confirmed. The applicable price is the one displayed at the time of the order.
Article 4 – Orders
The order is concluded when the Customer confirms their basket and payment; Cartel acknowledges receipt by email. Bikes and many items are one-offs or available in very small quantities: if an ordered product turns out to be unavailable, Cartel informs the Customer and refunds them in full within fourteen days at most. Cartel reserves the right to refuse an order for a legitimate reason, in particular in the event of an earlier unresolved dispute.
Article 5 – Payment
Payment is made online, at the time of the order, using the methods offered on the checkout page. Transactions are processed and secured by the payment provider; Cartel never has access to the Customer's bank details.
Article 6 – Deposits for made-to-order bikes
The Site allows a deposit to be paid to book the build of a Victoire or Distance bike. This payment constitutes a firm order. The Customer keeps a fourteen-day right of withdrawal from the payment, as long as manufacture to their specifications has not begun; they are then refunded in full. Once the bike's specifications have been agreed with the Customer (measurements, geometry, build, finish), the bike is an item made to the Customer's specifications and no longer gives rise to a right of withdrawal (Article L221-28, 3° of the French Consumer Code): the deposit is then no longer refundable if the Customer cancels. The total amount, the payment schedule and the build lead times are set out in the quote given to the Customer, which supplements these Terms.
Article 7 – Delivery
Current shipping rates are detailed in our shipping policy and displayed before the order is confirmed. Bikes are delivered within mainland France only. Unless a different lead time is shown when ordering, products are shipped within thirty days at most.
The risk of loss or damage passes to the Customer when they, or a third party they have designated, take physical possession of the product. We recommend that the Customer check the parcel in the presence of the carrier and note any anomaly on the delivery slip. For deliveries outside the European Union, any customs duties and import taxes are payable by the Customer.
Article 8 – Right of withdrawal
In accordance with Articles L221-18 et seq. of the French Consumer Code, a consumer Customer has fourteen days from receipt of the product to withdraw, without having to give a reason. They notify their decision by email to julien@cartelcycles.cafe or using the form in the appendix, then return the product no later than fourteen days after that notification, to: Cartel – SARL MVMT, 49 rue Victor Hugo, 63110 Beaumont, France. A bike can also be brought back directly to the Cartel shop, 12 place d'Espagne in Clermont-Ferrand.
Return costs are payable by the Customer. Cartel refunds all sums paid, including the initial shipping costs (at the standard delivery rate), within fourteen days of receiving the withdrawal decision; the refund may be deferred until the product, or proof of its dispatch, has been received. It is made using the payment method used for the order. The Customer may be held liable for any loss of value of the product resulting from handling other than what is necessary to establish its nature, characteristics and proper functioning (for example a component fitted to a bike, or a bike that has been ridden).
In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to goods made to the Customer's specifications or clearly personalised (custom-made bikes and frames, wheels built on request, etc.), nor to goods unsealed by the Customer after delivery which cannot be returned for reasons of hygiene or health protection (nutrition products, opened coffee).
Article 9 – Guarantees
All products benefit from the legal guarantee of conformity (Articles L217-3 et seq. of the French Consumer Code) and the guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code). The Customer has two years from delivery of the item to invoke the legal guarantee of conformity if a lack of conformity appears; during this period, they only need to establish the existence of the defect, not when it appeared (reduced to twelve months for used goods). The legal guarantee of conformity entitles the Customer to repair or replacement of the item and, failing that, to a price reduction or cancellation of the contract. The guarantee against hidden defects may be invoked within two years of discovering the defect.
In addition, Victoire and Distance frames carry a lifetime commercial warranty against manufacturing defects, under normal conditions of use. It benefits the first owner and transfers to a subsequent buyer provided they make themselves known to us within one month of their purchase. Excluded are damage caused by an impact or fall, overloading, lack of maintenance, inappropriate use, modification of the frame (painting, stripping, drilling) or repair carried out outside our workshops, as well as normal wear of the paint. This commercial warranty is in addition to the legal guarantees and does not replace them.
Article 10 – Liability
Cartel is not liable for non-performance of the contract attributable to the Customer, to the unforeseeable and insurmountable act of a third party, or to force majeure. Products must be fitted, adjusted and used in accordance with the manufacturers' instructions and good practice; if in doubt, our workshop is at the Customer's disposal.
Article 11 – Personal data
The personal data collected when an order is placed is necessary for its processing and delivery. How it is processed is described in our privacy policy.
Article 12 – Intellectual property
The texts, photographs, logos and trademarks on the Site are the property of SARL MVMT or its partners. Any reproduction without written permission is prohibited.
Article 13 – Mediation and disputes
These Terms are governed by French law. In the event of a difficulty, the Customer is invited to contact us first in order to seek an amicable solution. Failing agreement, a consumer Customer may refer the matter free of charge to the consumer mediator. They may also bring the matter before the competent court under the ordinary rules of law.
